Local Authorities are under a statutory obligation to annually review the financial support that they provide to holders of a Special Guardianship Order. The review should take place just before the anniversary of the start date of the allowance.

If the Special Guardianship Order (SGO) payments has not been reviewed every 12 months since it was put in place by the Court you could be owed money by the Council, and in some instances the sums could be huge.

How Does It Work?

As the holder of an SGO you are supposed to have your financial support reviewed annually by the Council, just before the anniversary of the start of your allowance. Have you? Or have you been receiving the same amount of money, or less, since the SGO started?

Ask yourself these questions:

  • 1. Have your SGO payments increased yearly as your child has got older?
  • 2. Have your SGO payments increased yearly with inflation?
  • 3. Have you had a yearly review with the Council about financial support and support needs for your child?
  • 4. Have you been sent a yearly Financial Pack by the Council?

How Much Compensation?

As a basic example, if you have been paid £200 per month less than you were entitled to, that is £2,400 per year times the number of years you have had your SGO Order for. 10 years of underpayments = £24,000 owed to you.

That is just an example but there are cases where people are being underpaid much more than £200 per month so the potential amounts of money owed are substantial and even life changing.
